Qualifications for H-1B Visa?

We recruit professionals with the following skills/skill sets.

The qualifications that are needed for an H-1B Visa are:

• Minimum of Bachelor's degree
• A specialty occupation of highly specialized knowledge
• Work Experience in the field you are applying for
• Sponsorship by an employer

How long is an H-1B Visa good for and can I reapply?

The visa is good for six years. After that time period, you must return to your home country for the period of one year. Then you can come back on H-1 for another six years.

What procedure do I need to follow to obtain my H-1B Visa?

The procedure for obtaining an H-1B Visa is as follows:

• Obtain a prevailing wage determination from the employment office that oversees the geographical area you will be employed in
• File an LCA with the U.S. Dept. of Labor
• File with the Immigration and Naturalization Service (INS)
• The employer can inform you of any additional steps that need to be taken

If I leave the U.S. during the six years that my H-1 is valid, what do I need to do?

You must procure a new visa to re-enter the U.S. This can be done at the Visa Office or the State Department in Washington, D.C. You can contact this department for further information.

What is the H-1B quota for India?

For both 1999 and 2000, the quota is 115,000.

What taxes are taken out of my paycheck in the U.S. and why?

The following taxes are taken out of your paycheck:

• Social Security tax (FICA) - this program is used to pay money to retired workers over 65, those who can no longer work due to a sickness or disability, and the families of workers who have passed away. All those working in the U.S. are required to contribute a set portion of their paycheck to this by law. The government determines percentages. Currently the percentage is 6.2%. Your employer is not responsible for any of this.
• Additional Information on Social Security can be obtained by calling 1-800-772-1213 or by visiting the web at www.ssa.gov
• Medicare Tax - provides medical and hospital insurance to people who qualify for low or no income. All those working in the U.S. are required to contribute a set portion of their paycheck to this by law. The government determines percentages. Currently the percentage is 1.45%. Your employer is not responsible for any of this.
• Unemployment Compensation (SUI) - provides assistance to workers who become unemployed. Employee contributions for state unemployment insurance is currently 6.25%.

Who can I claim as dependents?

Only your spouse and children or a child that you are a legal guardian for can be claimed as dependents. Furthermore, the above-mentioned can only be declared dependents if they are citizens or residents of the U.S., Canada or Mexico. Also you must provide more than half your dependents support during the year.

What are Federal Income Tax Returns?

By the end of January, you will receive via mail a document containing all pertinent salary and tax information from the past year. You will receive a separate document from each company that employed you over that time period. You will also receive similar documents from your bank if you have an interest bearing account. You will receive a Federal Income tax form from the government in January. You can either fill out the form yourself or take it to an accountant. All forms MUST be mailed and dated 11:59 pm April 15th. If not enough money in taxes was taken out of your wages, you will owe the government money and have to pay them the specified amount. If you had too much money in taxes taken out of your wages, you will get a refund from the government. These same rules apply to State Income Tax Returns as well.

Documents required for H1B (Non-US Citizens):

The following documents are needed if you have an existing H1B with another company.

1. Copy of all H1's including current and previous.
2. Copy of passport with all visas showing entry/exit out of the US, birth date and picture or prospective employee and family members.
3. 2 most resent payroll records.
4. Any previous immigration notices.
5. Copy of degree (BS/MS/PhD) and transcripts (mark sheets).
6. Copy of education evaluation (If available).
7. Updated resume.
8. Marriage Certificate and birth certificate of Children (If applicable)

The following documents are needed if you do not have a H1B (Changing from F1/PT to H1B or coming from overseas).
Please submit that applies to your case.

1. Current Residence
2. Copy of Passport with all the visas.
3. Any previous immigration notices.
4. Copy of degree transcripts (mark sheets).
5. I-94 of prospective employee and family members.
6. EAD (Employment documents)
7. I-20
8. Bachelor's Degree transcripts
9. Master's Degree transcripts
10. Ph.D. Degree transcripts
11. Marriage certificate Birth certificate
12. Two previous salary certificates
13. Any previous immigration certificates.
14. Employment Certificate
15. Updated Resume
